PRINMAIL USER AGREEMENT

PrinMail is a service provided to you for keeping in touch with your friends and classmates. No information herein (names, addresses, etc.) is to be used by you for any commercial, private, political, or institutional distribution or solicitation. It is Principia's policy to make every effort to insure the privacy of its mailing lists. Alumni names and addresses are used for Principia business only. Principia mailing lists are not sold to any outside party for any reason. A. Your Account PrinMail accounts are governed by and subject to the following rules: 1. Use of your account is expressly limited to you. Your account may not be transferred or shared with any other party, temporarily or permanently. 2. You agree to bear sole responsibility for all use of your account and for the confidentiality of your password. To protect your privacy, Principia will suspend access or change access to your account immediately upon notification by you that your password has been lost, stolen or otherwise compromised. 3. To cancel your account, you agree to contact Principia by sending email to alum@prin.edu or by calling 1-800-277-4648, ext. 2868. In the event of termination, you will remain obligated not to violate the rights of any person or entity with respect to any information you may have obtained via the PrinMail system. B. Rules of Conduct 1. PrinMail makes use of the Internet to forward your mail to you. Therefore, your conduct when using your PrinMail account is subject to Internet regulations, policies and procedures. You will not use PrinMail for chain letters, junk email, spamming, or any use of distribution lists to any person who has not given specific permission to be included in such a process. (If you receive any junk email from a principia.edu account, please forward a copy of it with your comments to abuse@prin.edu.) 2. You are prohibited from transmitting with your PrinMail account any unlawful, libelous, threatening, abusive, disruptive, or obscene material or message that would violate the rights of any person or constitute a criminal offense, or otherwise violate any local, state, national, or international law. Attempts to gain unauthorized access to other computer systems are prohibited. 3. Principia may terminate your account if it believes, in its sole discretion, that you have violated any of the Rules of Conduct. C. Representations, Warranties and Acknowledgment 1. THE PRINMAIL SYSTEM IS PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO THE PRINMAIL SYSTEM OR ANY INFORMATION OR SOFTWARE THEREIN. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL PRINCIPIA BE LIABLE FOR ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF OR INABILITY TO USE THE PRINMAIL SYSTEM. NOR SHALL PRINCIPIA BE RESPONSIBLE FOR ANY DAMAGES WHATSOEVER THAT RESULT FROM INTERRUPTIONS OF SERVICE, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE WHETHER OR NOT CAUSED BY EVENTS BEYOND PRINCIPIA'S REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO COMMUNICATIONS LINE FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO PRINCIPIA RECORDS, PROGRAMS, OR SERVICES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; AS A RESULT, THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. 2. You agree to indemnify and hold Principia, its officers and employees, harmless from any claims and expenses, including reasonable attorney's fees, related to your violation of this Agreement, including any abusive or unlawful conduct on the part of you or your dependents, or the infringement of any privacy or other rights of any person. 3. This Agreement will remain in effect until either party elects to terminate the Agreement in accordance with the Terms of this Agreement, or unless and until Principia notifies you that a renewal agreement must be entered. In addition, Principia reserves the right to terminate individual accounts or the entire PrinMail system at any time if it finds it necessary to do so. 4. This Agreement will be governed by and construed in accordance with the laws of the State of Missouri. Your use of the PrinMail system is subject to all local, state, national and international laws and regulations. You agree: (a) to comply with U.S. law regarding the transmission of technical data exported from the United States with your PrinMail account; (b) not to use PrinMail for illegal purposes; and (c) to comply with all regulations, policies, and procedures which may be published pertaining to the PrinMail system. © The Principia.
